Terms of Service

By using nexspark.org, NexSpark Friends, or NexSpark Tables, you agree to these terms. We've written them to be readable; readable still means binding.

1. The service

NexSpark Friends is a friendship product, not a dating service. It has two parts.

Circles. NexSpark Friends matches people into small friend groups ("Circles") based on a compatibility assessment, and provides tools for Circles to plan their own meetups. It makes no guarantee that any Circle, meetup, or friendship will succeed.

Guest visits and location. When you're away from home you may ask to join a Circle as a temporary guest in another area. A guest visit happens only if a Circle chooses to host you, and it is always time-limited, a guest position is never permanent. To make this work, when you request to guest, your profile and your home area (a neighborhood-level location, not a precise address or live location) are shared with the prospective Circles you're proposed to in the area you name, so they can decide whether to welcome you. By requesting to guest, you consent to that sharing. See our Privacy Policy for how location data is handled.

Tables. NexSpark Tables is a seating tool for events. A host creates an event and shares a link or a QR code; the people they invite give a first name and answer a short version of the same compatibility questions; we suggest who sits with whom and give the host a door check-in. Tables asks nothing else of a guest: no account, no identity verification, no app. A seat at a Table is a seat at someone else's event, it is not a Circle and it is not a match. Where the Tables provisions in sections 2, 6 and 7 differ from the Circles provisions, the Tables ones govern a Tables event.

Magnetism. NexSpark Magnetism is an optional, guided self-help program inside Friends that helps members practice building social confidence in small, everyday steps. It is educational self-help, not therapy, counseling, or medical treatment — see section 11 for the full disclaimer. Magnetism may include optional AI features, including the choice to connect your own external AI assistant; see our Privacy Policy for how that data is handled.

2. Eligibility

Members. You must be at least 18 years old and able to form a binding contract. The service is available across the United States, and Circles form in a given area once enough compatible members have joined nearby. You may hold one account, as yourself, no impersonation, no accounts on behalf of others. This 18-and-older requirement applies to NexSpark Magnetism as well — there is no separate, lower age threshold for it.

Tables hosts. A host must be at least 18 and takes on the responsibilities in section 7.

Tables guests. A guest needs no account, and we do not verify guests, a name at a Table is only the name someone typed. NexSpark is for people 18 and older, and that includes joining a Tables event through the link. Children are welcome at events, they simply don't sign themselves up: the questions are written for adults, so a host seating anyone under 18 adds them to the room by name, without an email address and without answering anything. Sending the join link to a guest under 18 is the host's to avoid (section 7). We don't knowingly collect information from anyone under 18 through Tables, and we delete it if we learn we have. Children at an event remain the responsibility of their parent or guardian, not of NexSpark LLC.

3. Cost

NexSpark Friends is free to join and free to meet, no card required for joining a Circle or attending meetups. Tables is free to host and free to join. If we ever introduce optional paid features, we'll say so clearly and in advance; nothing will ever be charged silently. Some events happen at venues that set their own prices, tickets, and house rules, those are between you and the venue, and we are not a party to them.

4. Verification

Joining a Circle requires completing a free, one-time identity verification (see our Privacy Policy for how that data is handled). We may remove accounts that fail or circumvent verification. Verification confirms identity; it is not a background check, and it is not a guarantee of anyone's character or conduct. Tables involves no verification of anyone: the host curates the room, and that is the only screening there is.

5. Your conduct

You agree to follow the Community Guidelines, which are part of these terms. In short: be who you say you are, treat members with respect, don't harass anyone, don't treat Friends as a dating pool, don't solicit members commercially, and don't misuse the platform. We may suspend or remove accounts that put members or the community at risk, and we'll tell you why unless safety requires otherwise.

Guests and hosts at a Tables event agree to the same basics for the length of that event, and we may remove a guest, an event, or a host from Tables on the same grounds.

6. Meetups and events happen in the real world

Circles plan and attend their own meetups. Tables events are created, run, and staffed by their hosts, and sometimes by a venue. In both cases NexSpark LLC does not host, supervise, or control the event, does not vet venues, hosts, or guests, and is not present. Use your own judgment: meet in public places, arrange your own transportation, and drink responsibly or not at all. You attend voluntarily and at your own risk. To the fullest extent permitted by law, NexSpark LLC is not liable for what occurs at or arises from a Circle meetup or a Tables event, including anything done by a host, a venue, or another guest.

7. Hosting a Table

If you create a Tables event, you are its host, and the following are yours.

The room is yours. You decide who is invited and who is admitted. We give you a seating suggestion and a check-in; we do not screen your guests, and we make no representation about any of them.

The invitations are yours. When you ask us to email an invitation, you are telling us you have that person's permission to receive one from you. Don't send marketing through invitations, and don't give us a list you bought, scraped, or collected for something else. You are responsible for claims arising from a list you gave us.

Guests under 18 you seat yourself. Don't send the join link to anyone under 18. Add them to your room by name instead, which seats them without collecting anything from them. The event questions are written for adults, and this is the only way we can keep children's information out of the product.

What guests give you is for the event. The names, email addresses, and answers your guests provide exist so the event can run. Don't export them into a mailing list, don't sell them, and don't use them for anything else.

The event is yours to run lawfully. Permits, alcohol, accessibility, safety, insurance, tax, and anything else the law asks of an event are the host's, not ours.

Keep your manage link private. Anyone holding it controls the event. If you lose it, we'll send a fresh one to the host email on file, which retires the old one.

8. Your content

You own what you write and share. You grant us the limited license needed to operate the service, to show your profile preview to your Circle, deliver your messages, and run matching. At a Tables event, that license covers showing your first name and your table number to the host and to the people seated with you, and showing the short reason you were seated together. We don't use your content for anything else without asking.

9. Our content

The NexSpark, NexSpark Friends, and NexSpark Tables names, marks, assessment, and site content belong to NexSpark LLC. Don't scrape, copy, resell, or reverse-engineer the service.

10. Leaving

You can delete your account at any time (see the Privacy Policy for data deletion). A Tables guest has no account to delete: the event's data is handled as the Privacy Policy describes, and you can ask us to remove yours sooner. We can suspend or terminate accounts that violate these terms. Sections that by their nature should survive termination, including 6, 7, 11, and 12, survive it.

11. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. Compatibility matching and Tables seating are informed judgment, not a promise of outcome.

Magnetism. NexSpark Magnetism is educational self-help, not therapy, counseling, psychiatric care, medical treatment, or a diagnosis. Using it does not create a clinician-patient or therapist-patient relationship, and it is not a substitute for professional care. It is not a crisis service: if you are in crisis or thinking about suicide or self-harm, call or text 988 (the Suicide & Crisis Lifeline) or call 911. Do not rely on Magnetism in an emergency. Magnetism’s content is written and approved in-house by NexSpark’s own curriculum owner; no part of it is developed, reviewed, validated, or endorsed by any psychologist, therapist, licensed clinician, licensed adviser, or other credentialed professional, and nothing on this site or within the program should be read as implying such review or endorsement.

12. Limitation of liability

To the fullest extent permitted by law, NexSpark LLC's total liability arising from the service will not exceed one hundred US dollars ($100) or the amount you paid us in the past twelve months, whichever is greater; and we are not liable for indirect, incidental, special, or consequential damages.

13. Governing law

These terms are governed by the laws of the State of Georgia, and disputes will be resolved in the state or federal courts located in Fulton County, Georgia.

14. Changes

If we change these terms materially, we'll notify members by email before the changes take effect, and Tables hosts at the host email on file for their event. Continuing to use the service after that means you accept the new terms. A Tables guest is covered by the terms in effect on the day of their event.
